Policies
The following policies are intended to ensure a smooth commission process for both artist and client. By placing an order, you acknowledge and agree to these terms.
Payment Policy
Custom portraits are commissioned artwork created specifically for each client.
Full payment is required before work begins.
Accepted payment methods include credit or debit card payments through the website (only major card companies accepted), or if in person, Venmo, Zelle, cash, or card tap.
Pricing includes applicable shipping and handling fees unless otherwise noted.
Because each portrait is custom-made, payments are non-refundable once work has begun.
Reference Photo Policy
The quality of the finished portrait depends partially on the quality of the reference photo provided.
Whenever possible, portraits are created from a single reference image. Basic photo edits, background modifications, and other adjustments may be made when appropriate.
In some cases, multiple reference photos may be used; however, this is determined on a case-by-case basis and may affect pricing.
Clients are responsible for ensuring they have permission to use any submitted photographs.
Approval & Revisions Policy
Before work begins, clients will receive a digital mockup for approval.
The mockup stage is the opportunity to review:

Composition
-
Cropping
-
Background choices
-
Overall layout
-
Framing selections
Revision requests may be made during this stage.
Once the mockup has been approved and payment has been received, work will begin on the portrait.
Completed artwork is not shown for approval prior to delivery unless otherwise agreed upon in writing before the commission begins.
As a result, revisions to finished artwork are generally not available.
Cancellation Policy
Clients may cancel a commission at any time before payment has been submitted.
Once payment has been received and work has begun, cancellations and refunds are not available.
If Elizabeth Spear Art is unable to complete a commissioned portrait, any payments received will be refunded in full.
Framing Policy
Clients may choose either:

Unframed artwork
-
Framing provided by Elizabeth Spear Art
Framing selections are made and approved during the commission agreement process.
If a client chooses to frame the artwork independently, Elizabeth Spear Art assumes no responsibility for damage that occurs during handling, framing, storage, transportation, or installation after delivery.
Soft Pastel Artwork Care
Soft pastel is a traditional fine art medium and should be handled with care.
While every effort is made to protect the artwork during packaging and shipping, small amounts of pastel dust may naturally settle during transportation. This is normal and does not indicate damage.
To protect the artwork:

Do not touch the pastel surface directly.

Do not attempt to clean, brush, or wipe the artwork.

Do not apply fixative sprays after receiving the artwork.

Store and transport the artwork flat whenever possible.
Soft pastel artwork should be framed using appropriate archival methods that prevent the artwork from contacting the glass.
A spacer, mat, or other separation system should be used to create a gap between the artwork and glazing.
Elizabeth Spear Art is not responsible for damage resulting from improper framing, handling, storage, environmental conditions, or modifications made after delivery.
Shipping Policy
Portraits are carefully packaged for shipment and delivered to the client's shipping address via either UPS or USPS depending on estimated turnaround and pricing. Tracking codes may be made available upon request.
Delivery times may vary depending on carrier schedules and destination. Expedited shipping may be available upon request but will incur additional charges.
Clients should inspect their package upon arrival and notify Elizabeth Spear Art promptly if shipping damage is suspected.
Elizabeth Spear is not responsible for any damage to the artwork, frame, or components in shipping or after delivery.
Copyright & Reproduction Rights
Elizabeth Spear retains all copyrights to the artwork.
Submitted reference photos may be used by the artist for marketing and promotional purposes.
The artist reserves the right to photograph, display, and use completed artwork for portfolio, website, social media, marketing, and promotional purposes.
The client receives ownership of the original artwork only. If agreed upon by artist and client, the artist may create reproductions of original artwork to sell online or in person.
Artwork may not be reproduced, sold, licensed, distributed, or used commercially without written permission from the artist.
Color & Display Disclaimer
Colors may appear slightly different in person than on digital screens due to variations in monitors, phones, tablets, and display settings.
Turnaround Disclaimer
Estimated completion dates are provided as a guideline only.
Actual completion times may vary based on commission volume, artwork complexity, material availability, illness, family obligations, weather events, shipping delays, or other unforeseen circumstances.
